Richie Design is in no way affiliated or associated with MySpace.com,
Facebook.com, Twitter.com or Youtube.com and/or any of their respective
companies or employees. .
1. Agreement of Terms
Accepting Richie Design's (RD) Terms of Service (TOS) electronically
or in writing, and/or by using Richie Designs Services, including
but not limited to submission of content, payment or authorization
of payment or sale, you (Client) agree to be bound by the following
terms and conditions.
You also agree that your electronic acceptance of these TOS shall
have the same force and effect as if you had agreed to these TOS in
writing. By using RD' Service you also agree to the most current version
of the TOS. Failure to comply with the TOS may result in termination
of design.
2. Service description
Richie Design creates custom MySpace pages and provides other Website-related
services including, but not limited to: support and modification of
Websites, Facebook Landing pages and applications, Twitter Backgrounds,
YouTube modification and flash.
3. Liability
RICHIE DESIGN WILL NOT BE HELD RESPONSIBLE FOR ANY CHANGES TO THE
MYSPACE.COM OR FACEBOOK.COM DATABASE AND/OR PROFILE CODES. YOU AGREE
THAT ANY EDITS OR CHANGES INITIATED AFTER YOUR COMPLETED PROFILE HAS
BEEN PUBLISHED TO MYSPACE.COM OR FACEBOOK.COM IS NOT THE FAULT OF
RICHIE DESIGN BUT A RESULT OF MYSPACE.COM OR FACEBOOK.COM UPGRADES.
RICHIE DESIGN WILL NOT BE HELD RESPONSIBLE FOR THESE CHANGES NOR BE
LIABLE TO REPAIR THE AFORMENTIONED CHANGES.
YOU ARE AWARE THAT NO REFUNDS WILL BE GIVEN WHATSOEVER IF THESE CHANGES
OCCUR. RICHIE DESIGN MAKES EVERY EFFORT TO DESIGN PAGES WHICH DISPLAY
ACCEPTABLY IN THE MOST POPULAR CURRENT BROWSERS, BUT CANNOT ACCEPT
RESPONSIBILITY FOR PAGES WHICH DO NOT DISPLAY ACCEPTABLY IN NEW VERSIONS
OF BROWSERS RELEASED AFTER PAGES HAVE BEEN DESIGNED.
Richie Design reserves the right to charge a reasonable fee for correction
of errors for which Richie Design is not responsible, including, but
not limited to modification of the Website code by a third party.
4. Unsuitable Content
You understand that all content on your Website is the sole responsibility
of the Client. You are fully responsible for all Website Content and
agree to hold Richie Design harmless in the event of third parties'
legal issues brought against you for your business practices.
5. Design Practises
Richie Design will not be held liable for accuracy of information,
typos, or spelling mistakes in any of the content approved by the
Client and published. Richie Design takes no responsibility for the
functionality or maintenance of the MySpace or Facebook profile after
the work has been completed. Errors attributable to Richie Design
will be corrected free of charge, but Richie Design reserves the right
to charge a reasonable fee for correction of errors for which Richie
Design is not responsible, including, but not limited to malicious
modification of the Website by a third party and errors contained
in materials provided by the Client. Any additions or changes requested
outside of original brief or approved design prior to the Website
going live will be billed at Richie Designs' standard hourly rate.
There will be NO REFUNDS of any kind for pages that have already begun
the design process. All hours of designing work put into each design
has to be accounted for.
6. Billing
Requested changes to the finished original site will be billed separately
at the time of request. Richie Design reserves the right to change
prices at any time including hourly design fees. Failure to complete
payment for projects that have reached completion will result in the
removal of all Richie Design work until full payment is made. Client
agrees to pay in full within 14 days after completion and recognizes
Richie Designs no-tolerance payment schedule. Failure to meet these
requirements may result in legal action. If Richie Design receives
no response over a prolonged period of time regarding the project,
all remaining payments will be due immediately.
7. Client Information
The client herby gives permission to Richie Design to use samples
and links to Client's custom Website designed by Richie Design for
marketing and advertising purposes, including but not limited to use
in our portfolio. The Client should ensure that data on their site
is regularly backed up and that a contingency plan is in place to
minimize possible losses as a result of software failure.
8. Warranties
YOU AGREE THAT ANY MATERIAL DOWNLOADED OR OBTAINED THROUGH THE USE
OF ANY RICHIE DESIGNS SERVICES IS DONE AT THE CLIENTS OWN RISK AND
THAT THE CLIENT WILL BE SOLELY RESPONSIBLE FOR ANY DAMAGES TO THEIR
COMPUTER SYSTEM OR LOSS OF DATA OR OTHER LIABILITY THAT RESULTS FORM
THE DOWNLOAD OF SUCH MATERIAL.
9. Territories
This TOS Agreement shall be governed by the laws of the United Kingdom
which shall claim venue and jurisdiction for any legal action or claim
arising from the contract between Richie Design and the Client.
10. General Information
The section titles in the TOS are for convenience only and have no
legal or contractual effect.
